TWO YEAR LIMITED WARRANTY
Bird Control Group products are warranted to be free from defects in materials or workmanship for two (2) years from the date of purchase from an authorized reseller of Bird Control Group products.
Within this period, Bird Control Group will, at it’s sole discretion, repair or replace any components that fail in normal use. Such repairs or replacement will be made at no charge for parts and/or labor. Replacement products may be new or refurbished at our discretion.
This warranty does not apply to: (i) cosmetic damage, such as scratches, nicks, stains and dents; (ii) consumable parts, such as batteries, unless product damage has occurred due to a defect in materials or workmanship; (iii) damage caused by accident, abuse, misuse, water (in excess of specifications), flood, fire, or other acts of nature or external causes; (iv) damage caused by service performed by anyone who is not an authorized reseller; (v) damage to a product that has been modified or altered without the prior written permission of Bird Control Group; or a product where the serial number has been removed.
Repairs have a ninety (90) day warranty. If the unit sent in is still under its original warranty, then the new warranty will be the longer of ninety (90) days or the balance of the original two year warranty. The warranty's and remedies contained herein are exclusive and in lieu of all other warranties express, implied, or statutory, including and liability arising under any warranty of merchantability or fitness for a particular purpose, statutory or otherwise. Subject to applicable law, in no event shall our liability exceed the purchase price of the products. If a defect is reported after the warranty period Bird Control Group can offer an assessment of the defect including quotation for repair or replacement, following the return policy as described below.
For all returns, including warranty and after-warranty returns, you must pack your product in its original packaging and include all accessories and documentation. We reserve the right to charge for any damage to the product, and missing part fees may apply. Please contact Customer Service prior to returning any product to receive a return authorization form and RMA number. You will be responsible for, and pre-pay, all return shipping charges and shall assume all risk of loss or damage to product while in transit to us. We recommend that you use a traceable method of shipping for your protection. We will pay for shipping to return any product to you.

The following Terms and Conditions apply to all users of this website (www.birdbeam.com.au) and the products and services offered within it. In these Terms and Conditions, the terms “We”, “Us” and “Our” refer to the above name. “You” are the user of this website (and “your” has a corresponding meaning). The term “Customer” refers to the person or company purchasing goods and/ or services offered on this website.
Anyone who purchases laser products should abide by governing local and national laws and regulations. Bird Beam Laser Bird Control Systems accept no responsibility for actions after purchase regarding this matter.
The Customer acknowledges agreement with these Terms and Conditions by the placement of an order to purchase products from Bird Beam Laser Bird Control Systems.
If you do not accept these Terms and Conditions, you must refrain from using this website and from purchasing any products and services offered on it.
Disclaimer and Liability
Every effort is made to ensure the information contained on the Website is correct, however Bird Beam Laser Bird Control Systems makes no warranty as to the accuracy, comprehensiveness, or correctness of any products on the Website and provides all products on an ‘as is’ basis.
Customer orders accepted by us are only by email, after the Customer has read their full site Proposal; including responsibility and investment matrix, which includes information on warranty.
We ship all goods after the Customer has made payment in full.
We reserve the right to cancel unpaid orders after 14 days.
We will notify the Customer with the approximate shipping date.
Installation dates will only be given after Client has concluded fabrication infrastructure as specified in the site Proposal.
Shipping cost for all Customer orders depends on order size and weight. We will include shipping cost as part of our quotation.
International deliveries / costs are client responsibility to organize and ship.
All customer orders should arrive within 7 to 14 business days depending on location. Please inform us if your order has not arrived after 10 business days.
Bird Beam Laser Bird Control Systems shall not be held responsible or liable in any way for delays or defaults in delivery of the order or any part thereof nor for any direct or consequential loss or damage arising there from.
Risk in any goods supplied shall pass to the customer at the point of delivery. The Customer, upon taking delivery of the goods, shall immediately examine the goods and give written notice to us of any defect within two (2) days of such date, failing which the goods shall be deemed to have been delivered in good order and condition and accepted by the Customer.
If the Customer fails or refuses to take delivery of the goods, then in addition to all other rights and remedies of Bird Beam Laser Bird Control Systems, the Customer shall be liable for all loss and damage including consequential loss and damage suffered or incurred by Bird Beam Laser Bird Control Systems as a result thereof. Bird Beam Laser Bird Control Systems, at its discretion, may charge a restocking fee of up to 15% of the purchase price.
All items are thoroughly checked before dispatch.
Bird Beam Laser Bird Control Systems shall not be held responsible for damage or loss to goods in transit. If you find an item being damaged, please contact the courier company immediately.
Changes to Terms & Conditions
Bird Beam Laser Bird Control Systems reserves the right to change these Terms and Conditions of its service without informing you. You should check our Website regularly for any updated Terms and Conditions.
The Terms and Conditions for existing orders shall be upheld by Bird Beam Laser Bird Control Systems within the validity timeframe of the site Proposal.
Default / Failure to pay
If the customer fails to comply with any of these Terms and Conditions, becomes bankrupt or is put into receivership, liquidation or statutory management, Bird Beam Laser Bird Control Systems is entitled to cancel any orders already made and all money owing to Bird Beam Laser Bird Control Systems by the customer will become immediately due and payable. Bird Beam Laser Bird Control Systems will be entitled to recover from the Customer any losses, damages, costs, interest, fees, charges (including handling charges payable by the Customer) and expenses incurred by Bird Beam Laser Bird Control Systems because of the Customer’s default and the subsequent cancellation of such order by Bird Beam Laser Bird Control Systems.
Laws and Limitation of Liability
Bird Beam Laser Bird Control Systems will under no circumstances, except where the consumer guarantees apply, be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein.
The customer agrees that for any liability related to the purchase of products or services, Bird Beam Laser Bird Control Systems is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase(s) under this agreement.
If any parts of these Terms and Conditions shall be held to be illegal, unenforceable, or invalid, the remaining parts shall continue in full force and effect. The laws of the state of Tasmania, Australia, shall govern these Terms and Conditions regardless of the location of the Customer. The Customer irrevocably submits to the exclusive jurisdiction of Tasmanian courts and courts hearing appeals from those courts. The customer hereby waives any right they may have to claim that the above submission to jurisdiction is an inconvenient forum.
Any claims for errors or unsatisfactorily work must be made within seven (7) days of issue of an invoice.
Bird Beam Laser Bird Control Systems is only under an obligation to deliver goods and services in accordance with their general description, whether a special description may have been given or implied by law.
The customer acknowledges and agrees that Bird Beam Laser Bird Control Systems has not given any representation or warranty as to the quality, state or condition of goods supplied, or that the goods are fit for any particular purpose.
All conditions, warranties, and terms whether implied, statutory, or otherwise are excluded to the fullest extent permitted by law.

Customers have specific legal rights under the Australian Consumer Law in respect of goods and services purchased from Bird Beam Laser Bird Control Systems. As a business we are meeting our obligations within the Australian Consumer Law. We therefore offer Conditional refunds and replacements.
Details of our return’s guidelines are outlined below. If returned goods do not meet these criteria, a refund will be declined, and we will return the products to you. Bird Beam Laser Bird Control Systems reserve the right to charge for shipping costs incurred as a result.
Refunds are made if goods are returned in original and resalable condition with all packaging, manuals, and registration cards within 4 weeks of receiving goods.
We cannot accept returns after 30 days.
A restocking fee of 15% applies and shipping charges are the responsibility of the customer and will not be refunded.

Returned items that are missing parts, faded or are not in new condition may not be accepted by us or will be charged a restocking fee at our discretion which exceeds the minimum restocking fee of 15%.
Please contact us to obtain your return authorization number before returning any goods.
You must return your goods within the validity period of your return authorization number, e.g., seven days. Returns without valid return authorization number will incur a 20% restocking fee.
Presentation of the purchase receipt and a return authorization number are required for all returns.
Some items are not returnable under any circumstances. These include all consumables and all special purpose or special-order goods. Special order goods are goods that are not in stock at the time of an order and therefore especially ordered to meet a Customer order, i.e.; special order eye wear, handheld units, batteries, solar panels.
Return shipping charges are the responsibility of the customer and will not be refunded.
Damage due to improper packaging or loss of goods is at the risk of the Customer and may result in the refund being declined. We recommend using a track and trace shipping option using a reputable carrier.
